dot-BIZ Gets the Business |

The WashTech.com section of the Washington Post carries a Reuters wire story reporting that Los Angeles Superior Court Judge Anthony Mohr has halted the lottery to distribute ".biz" domain names (Judge Bars Lottery for ".biz" Web Addresses). The company ICANN had chosen to roll-out the .biz domain, NeuLevel, decided to hold a lottery (for which an entrance fee of $2 - $15 was required) to determine ownership of any .biz domains that were disputed. Judge Mohr decided that this violated California state law; in addition to the injunction, NeuLevel must put aside $3million for possible refunds. The number of affected domain names is approximately 20% of the total that have been registered - about 58,000. The other 80% of registered domain names are unaffected and should become active Oct. 23. NeuLevel's response is here (Statement from Douglas B. Armentrout, CEO, NeuLevel, Inc.). ICANN's position on this matter is that the California judge's decision violates well-established jurisdictional principles, depriving non-Californians of their rights (Advisory Concerning Smiley Litigation).
