USDOJ - Academics Have Nothing to Fear from DMCA
Posted by Ernest Miller on Friday, October 12 @ 21:38:36 EDT Copyright
InfoWorld reports on the DOJ's motion to dismiss in the case of Princeton University Professor Edward Felten against the DOJ, SDMI and others to permit him to present research on digital rights management technologies without violating the Digital Millennium Copyright Act (DMCA) (Ashcroft to academics: DMCA is not your problem). The DOJ rebuffed the suit in its motion to dismiss, claiming that Felten was asking for protection from legislation that had not threatened them, which seems odd in light of this letter from the RIAA to Prof. Felten (RIAA/SDMI Letter, April 9, 2001), which states, in part, "[if Prof. Felten releases his research to the public, he] would subject [his] research team to enforcement actions under the DMCA and possibly other federal laws." The Electronic Frontier Foundation (EFF), which is providing the legal muscle for this case has a link to the brief (DoJ (Ashcroft) Motion to Dismiss in Felten v. RIAA [PDF]) as well as other documents in the case (Felten v RIAA Resources) and links to (Media Coverage). Slashdot discusses this recent development (DoJ Supports Dismissal of Felten v. RIAA Case).
