RIAA sued for amnesty program |

On Monday, the RIAA announced an amnesty program, "The Clean Slate Program," for admitted file-sharers. The Program claims it offers protection for songs the RIAA represents but not from other publishers, musicians or others with rights to the songs. Under the program, the RIAA won't sue users who sign and notarize their Clean Slate Program affidavit, erase downloaded music and promise not to share music on the Internet.
According to an article by CNN.com, the amnesty offer won't apply to some 1,600 people targeted by RIAA copyright subpoenas.
Now, the RIAA is being sued. The lawsuit seeks a "remedy to stop the RIAA from engaging in unlawful, misleading and fraudulent business practices."
Erick Parke, a private citizen, filed a complaint alleging that "the legal documents do not provide any real clean slate," according to Parke's attorney. "The legal document does not even provide for a release of claims against suits brought by RIAA members." Parke's complaint further alleges that the RIAA does not agree to destroy data or promise to protect users from further suits from it or RIAA members. The suit asks the court to enjoin the RIAA from falsely advertising its program.
