Anonymous writes "Recently the FCC has solicited comments [PDF] on expanding the frequencies within which class-licensed radios (“unlicensed devices”) are allowed to operate. The Slashdot discussion of this issue doesn’t have much about constitutional law. But recent papers have argued that in the U.S. idle spectrum is a violation of the First Amendment, and that revolutionary ideas about good governance (also here) should be the starting point for discussion of spectrum policy. Meanwhile, Wi-fi, a standard for class-licensed, short-range, broadband, wireless Internet access, is growing rapidly. Perhaps technology will sort everything out for the best without any need to consider constitutional law. If you believe that, quit law school and start writing West-coast code. "
