RIAA Attempts to Hijack Antiterrorism Bill
Posted by Ernest Miller on Tuesday, October 16 @ 00:52:06 EDT Copyright
Declan McCullagh writing for WIRED reports on a nasty attempt by the Recording Industry Association of American (RIAA) to sneak some very bad legislation into the anti-terrorism bills shortly before they were voted on (RIAA Wants to Hack Your PC). The proposed amendment to the cybercrimes portion of the bill stated that,
no action may be brought under this subsection arising out of any impairment of the availability of data, a program, a system or information, resulting from measures taken by an owner of copyright in a work of authorship, or any person authorized by such owner to act on its behalf, that are intended to impede or prevent the infringement of copyright in such work by wire or electronic communication.
The amendment would essentially eliminate any liability for vigilante hacking done by the copyright industry. If the RIAA intends to halt your sharing of MP3s on a network by sending a virus that crashed your system, they would not be liable. C|Net News reports on this, but also points out the technological control measures the industry is using now - some seem legal, others seem questionably legal (Online music wars inspire new weaponry). The LA Times also covers this nefarious business (Music Firms Fail to Get Anti-Piracy Proposal on Bill). The Register has a short piece on this debacle (Recording industry exploits WTC tragedy to hack you). Slashdot hosts two discussions of this attempted hijacking (RIAA Wants Right To Hack) and (RIAA Abandons Hacking Amendment). WarTimeLiberty.com has another version of the proposed amendment (Look Out Pirates: RIAA Wants to Hack Your PC).
