Dispatches From the Front: Pavlovich v. California
Posted by Ernest Miller on Thursday, September 05 @ 22:51:11 EDT Digital Millennium Copyright Act
Denise Howell of law metablog Bag and Baggage attended oral argument before the California Supreme Court today in the Pavlovich branch of the DVDCCA DeCSS case (Part I: Pavlovich v. Superior Court (or: why you may have to learn to love the California court system if you're posting on the Web)). This particular case will determine whether California can exercise jurisdiction over an individual who posts something on a website if it will have an effect on an industry "commonly known" to have a presence in the state (which would probably be most industries). She promises a full account of the "circus" in part II tomorrow. Stay tuned; LawMeme will post a link to part II as soon as it is available.

UPDATE1936 ET 06 Sep 2002
Unfortunately, part II doesn't get to the heart of the matter, but does a good job setting up atmosphere (Part II: Pavlovich v. Superior Court (or: why you may have to learn to love the California court system if you're posting on the Web) ). I'll post a new entry to LawMeme when part III is available.

In the meantime, Law.com has a nice piece (Rockets Fly Over DVD encryption Case Jurisdiction).
