Is Backing Up DVDs Fair Use or Infringement? 321 Studios Suit Update

Robert H. Moore says it is fair use. Indeed, his company's business model is predicated on the assumption: 321 Studios' DVD Copy Plus permits users to make backup copies of their DVDs.

Earlier in the year, the company sued nine movie production houses, in which it sought the judge's permission to continue selling its software. The complaint is here. LawMeme's coverage is here.

IMO it's much the same as backing up CD's or video games that you own.

While we technically can under fair use, the companies will argue until they are blue in the face that we can't.
