Image Thumbnails and Copyright

The New York Times (reg. req.) features an article regarding the copyright implications of image search engines (Do Search Engines Expedite the Theft of Digital Images?). The case discussed is Kelly vs. Arriba Soft Corp. (now doing business as Ditto.com). The district court decision (finding for defendant) is available on the web (Kelly vs. Arriba Soft Corporation, December 15, 1999, Case No. SA CV 99-560 GLT[JW]). This isn't the only lawsuit Kelly has brought; you can read more about his lawsuits at his consulting service: Netcopyrightlaw.com.
