Solum and Volokh Discuss IP
Posted by Ernest Miller on Tuesday, September 16 @ 03:31:49 EDT Copyright
A few days ago, LawMeme noted a discussion about the theoretical justifications for IP law in the abstract between UCLA's Prof. Volokh and USD's Prof. Solum (Does IP Make Sense?). Volokh has briefly responded to Solum's initial reply (Larry Solum on I/P) and Solum continues the conversation with a lengthy post (Water Wells and MP3 Files: The Economics of Intellectual Property). Both pieces are well worth reading (pun intended). If you are interested in a more formal presentation of these concepts, Solum links to a couple of entries in the Encyclopedia of Law and Economics - (Intellectual Property: General Theories by Peter S. Menell [PDF]) and (Copyright by Wendy J. Gordon and Robert G. Bone [PDF]).
