Chilling Effects on Black Friday and FatWallet.com

FatWallet.com, a website that tracks shopping bargains, was sent a cease and desist notice under the DMCA last week for posting prices from various stores' "Black Friday" circulars ( DMCA, Black Friday - where we stand, and what we are doing about it). "Black Friday" is the day after Thanksgiving in which stores move, hopefully, from red losses to black profits in their accounting.

This is a very dubious use of the DMCA's already dubious notice and takedown procedures. The Washington Post has a brief mention (Sale Sites Get Shushed). Chilling Effects has written up a link-rich analysis and explanation of the case as one of their "Weather Reports" of which I hope there will be more in the future (Bargain Shoppers Chilled by Retailers' DMCA Threats).
