WIPO Takes Neo-Nazi Domain Names
Posted by Ernest Miller on Wednesday, January 30 @ 11:31:03 EST Trademark
ICANN Watch blogs the story of a recent WIPO decision regarding neo-nazi domain names (WIPO arbitration on neo-nazi use of domain names). Read the Spiegel Online version in German (US-Neonazi muss Web-Adressen abtreten) or read the Babelfish translation to English (US neo-Nazi must Web addresses transfers). Apparently, a convicted German neo-Nazi had a U.S. ISP hosting websites such as "bundesinnenministerium.com" ("Ministry of the Interior") and "verfassungsschutz.org" ("Office for the Defence of the Constitution"). Because the websites were based in the U.S., under the First Amendment the websites could not be touched by the German authorities. However, using the UDRP the German government was able to get the domain names transferred to their control under a default judgement. Read the decision (Bundesrepublik Deutschland (Federal Republic of Germany) v. RJG Engineering Inc.).
