Hooked on Phonics Must Learn to Read Own Privacy Policy

The FTC has settled its first case about retroactively applying changes in a privacy policy.

In July 2003, the Washington Post reported large changes in Hooked on Phonics's privacy policy as well as some inconsistent marketing information. The FTC alleged that HOP sold customer (parent) information as well as ages, genders, or other information about the children, even to customers who gave the data before the privacy policy changed. HOP has settled the claim without admitting wrongdoing. The FTC's position is clear. Customers must actually consent to a change in a privacy policy: “You can change the rules but not after the game has been played.”
