Ebay Too

www.ebaytoo.com is operated by a John Wederman from Schenectady. Like eBay, "E-bay Too" (as the <TITLE> tag says) is an auction site, and lets users buy and sell goodies like bikes, books and electronics, inter alia.

At the moment, the total count of available sale items is 23.

In any case, given the web site's URL, Wederman probably isn't exactly shocked to find that eBay is suing him for copyright infringement. The company's attorneys have accused him of trying to "trade on the eBay name and to take advantage of initial consumer unfamiliarity and confusion."

Incidentally, Wederman still owes eBay $132.56 in fees he had previously accrued as an eBay member.

I'm confused. Why wouldn't this be a trademark issue instead of a copyright issue?
Did he directly take HTML or pictures from eBay or something?
