Heads up: Microsoft memo not admitted

If you call a Dell support technician and tell him or her that you're using Linux when s/he asks what operating system you're running, s/he -- at least in my oft-repeated experience-- will react with surprised silence, repeat the question, dismiss your answer with a puzzled "oh", ignore it, or challenge your decision not to run Windows and ask, "why?" And that's because Dell doesn't provide any support for Linux.

Dell might have made the decision not to support Linux for any number of reasons, but you have to wonder what those reasons may be when reading about Microsoft memos that rage against the open source platform and computer makers that support it.

One such memo was sent by Microsoft Senior Vice President Joachim Kempin on August 14, 2000. In it, the Microsoft executive warned that Intel encouraged computer manufacturers to support Linux, and suggested that Microsoft impose harsher "anti-Linux actions" on Linux-prone computer makers. Kempin also recommended withholding technical data from Intel.

Kempin's suggested tactics obviously resonate strongly with the District of Columbia and the nine states that have continued to press for tougher penalties against Microsoft. On May 13, they filed a request that the email be considered in the trial.

The motion was denied yesterday. U.S. District Judge Colleen Kollar-Kotelly will not admit the document because she agrees with Microsoft's claim that its admission would unfairly prejudice Microsoft's defense.
