MS and USDOJ Fail in Settlement Talks |

The WashTech.com section of the Washington Post reports that U.S. District Judge Colleen Kollar-Kotelly, who is now overseeing the case, will appoint a mediator next week to help Microsoft and the DOJ's Antitrust Division and 18 state prosecutors to settle the case (Judge to Appoint Mediator to Microsoft Case). The judge "grilled them and grilled them" to determine whether talks to this point had been serious. The New York Times (reg. req.) also reports on the talks failure, including the parties' failure to agree on a mediator (No Settlement by Deadline in Microsoft Antitrust Case). SiliconValley.com takes a look at the failure and points out the fear on the part of the state prosecutors that the DOJ will agree to a settlement that has no teeth (Prosecutors, Microsoft fail to reach settlement). C|Net News' coverage is very good, taking a look at why previous settlement talks under respected Judge Richard Posner of the Seventh Circuit failed as well as possible sticking points, such as how the settlement might apply to the Windows XP (Microsoft, government fail to settle).
