MS/Sun judge says bunding Java with Windows is ''attractive''
Posted by James Grimmelmann on Wednesday, December 04 @ 13:28:52 EST Antitrust
Sun has asked the judge in its private antitrust suit against Microsoft to require MS to include Sun's Java interpreter with every copy of Windows XP shipped. According to News.com, Judge Frederick Motz found this idea "attractive", but had reservations about whether the solution would benefit consumers and not just Sun.

Motz said that the bundling would be "wonderfully elegant and simple" as a remedy (presumably, in comparison with strong structural remedies or the complex settlement MS worked out with the DOJ). However, he expressed doubts that Java really needs the competitive boost; Microsoft has been trying to argue that Java is enough of a success that Sun doesn't need the help.

Let's see if I understand: Sun sues Microsoft to force MS to stop polluting Sun's competitive weapon against Microsoft, which is Java. Sun wins and Microsoft is ordered to stop distributing the polluted version.Microsoft replies with a brilliant judo move, "complying" with the order by removing Java entirely from the Windows distribution. Now Sun is suing to force Microsoft to distribute Java with Windows. I am no fan of Microsoft, but does anyone find this a bit childish on Sun's part? They announced they were going to attack Microsoft with Java, Microsoft came up with a superior competitive response, Sun lost. Too bad for Sun, but what business does this case have in federal court? Can't Sun just run to Microsoft's mommy or 2nd grade teacher and whine? That's what sore losers usually do.sPh
