'Browse Wrap' Contracts found not enforceable

Slashdot discusses (Court Finds Online Software License Not Binding) a report (Online 'Browse-Wrap' Software License Agreement Not Binding) on Law.com. "Browse-Wrap" differs from "Click Wrap" in that the licensing information is available on the website, but someone who downloads the software never has to "click" some sort of "I agree" button. The putative class action suit, Specht v. Netscape Communications Corp, concerns possible privacy violations that a freely downloadable Netscape product ("SmartDownload") enables. Read the complaint or get more information from the plaintiff lawfirm, Abbey Gardy, LLP. But see, Pollstar v. Gigmania, which held that a "Browse Wrap" contract may be enforceable.
