"Wind Done Gone" Ruling Gives a Damn
Posted by Ernest Miller on Saturday, October 13 @ 22:49:56 EDT Copyright
Law.com consults experts on the Eleventh Circuit federal appellate ruling last Wednesday upholding publication of Alice Randall's The Wind Done Gone as a parody of Margaret Mitchell's 1936 classic, Gone With the Wind ('The Wind Done Gone' Copyright Ruling May Have Lasting Impact). Those not involved in the case are generally very positive about the ruling. FindLaw carries a good Reuters wire story discussing the decision and pointing out that Margaret Mitchell's estate may still be owed some damages (Court Affirms 'Gone with the Wind' Parody Ruling). USA Today carries the AP wire story (Court rules for 'Wind Done Gone'). Read the 62 page opinion for yourself (Suntrust Bank v. Houghton Mifflin [PDF]).
