Donald Trump, whose reality-television show "The Apprentice" has been a smash hit this season, is worried that others will take advantage of his catchphrase. While surely even the Donald must be aware that he did not invent the phrase "you're fired," he believes his weekly recitation is enough to warrant a trademark. The Smoking Gun has released copies of Trump's trademark application. While he doesn't expect his trademark rights to extend beyond games, casino services and clothing (Reuters), it turns out there are others who claim they got there first.
The Chicago Tribune is reporting the story of Susan Brenner of Northbrook, Illinois, who runs a ceramics studio and pottery store in suburban Chicago called "You're fired!" She's worried that all of the time and money she has spent in gaining name-recognition will be lost if Trump enters the marketplace. So, she has retained an attorney to draft Trump a letter questioning his patent application. While she did not have the foresight to pursue a trademark of her own, she should retain some protection within the Chicago area.
It wouldn't be a surprise if Trump's application ends up, well, trumping the pottery store's claims. And why not? After all, the man does have bills to pay. But, I'd like to think that the little guys deserve protection, too, and I hope that neither Trump nor the legal system will trample those in the way of Trump's path to economic domination.

I thought he used it in connection with a "reality" TV show. If so, wouldn't it only apply to whatever products or services are associated with television programming? |
