The Eldred Decision and the DMCA

Professor Jack Balkin has written a very interesting piece on the possible effects of the Eldred decision on the DMCA. Professor Balkin goes as far to state that the DMCA is actually unconstitutional as a result of the Eldred decision. Balkin has an earlier piece on the Eldred decision here.
